Our
Services in Magistrates' Courts
In the Magistrates' Courts, the Duty Lawyer Scheme covers some 300
statutory and common law offences under our Standard
List of Offences. Where the interests of justice so require, the Service may also provide legal assistance on bail applications pending trial and sentence for Magistrates’ Courts defendants in the Court of First Instance of the High Court. However we do not offer representation for:
 |
committal proceedings; |
 |
hawking offences; |
 |
traffic summonses; and |
 |
other "regulatory offences" such as departmental summonses
issued by: |
|
- |
Environmental Protection Department; |
- |
Inland Revenue Department; |
- |
Fire Services Department of the HKSAR Government. |
|
If you are charged with an offence under our Standard List of Offences,
you will be provided with legal representation for your first court
appearance without any means testing. However
if you wish to have legal representation for subsequent appearance,
you must come to the Court Liaison
Office to do the means test. After passing
the means test, you are required to pay one fixed handling
charge of $640. This is the only charge any defendant has to pay,
no matter how long the trial lasts.
